Utah Property Review · No Obligation

Start With Your Property, Timeline, and Priorities.

Share the address and situation so Benard Homes can determine whether a direct proposal is available. You can then compare its written terms with other selling paths.

Three Possible Paths

Compare More Than the Headline Price

Ask for consistent assumptions about repairs, closing items, contingencies, timing, and estimated net proceeds.

Direct as-is transaction

Owners prioritizing convenience or a shorter process

  • Property-specific written proposal
  • May reduce repairs and showings
  • Price and closing remain subject to the agreement

Trade-off: A convenience-focused direct price may be lower than the result of broad market exposure.

Traditional listing

Owners prioritizing market exposure and able to manage the process

  • Broad buyer exposure
  • Potential for competing offers
  • Often includes preparation, showings, costs, and contingencies

Trade-off: The final price and timeline are uncertain until a buyer closes.

Other written structure

Properties that fit a carefully reviewed, situation-specific arrangement

  • Not available for every property
  • Written obligations and exit terms matter
  • Independent legal review may be appropriate

Trade-off: A novation-related arrangement is not the same as a subject-to transfer; labels never replace the contract terms.

Know the estimated net before deciding

No separate fees or commissions are charged to you on a direct cash sale. Benard Homes LLC's compensation is calculated into the transaction price — what is offered is what you receive at closing. On a novation (Fast Track) listing, compensation terms are disclosed in the written agreement before you sign.

What is novation?

A novation agreement (also called the Fast Track Program at Benard Homes) is a hybrid option where Benard Homes lists your home on the MLS to maximize market exposure while providing the same hands-on support as a cash sale. If the home does not sell within the agreed timeframe, Benard Homes purchases it directly. All terms — price, timeline, and compensation — are set out in the written agreement before you sign.

How is subject-to different?

A 'subject-to' purchase means a buyer acquires the property while the existing mortgage remains in the seller's name. The buyer makes the payments, but the original borrower retains legal liability for the loan. This arrangement carries significant risk for the seller and should only be considered after consulting a licensed Utah real estate attorney.

What Comes Next

What Happens After the Questionnaire?

1

Details Are Reviewed

Property and situation details are evaluated. Available property facts and comparable sales may be reviewed, and additional information or a walkthrough may be requested.

2

A Possible Path Is Explained

If a direct transaction may fit, its written price, identified costs, contingencies, timing, and estimated net are presented for comparison. Another resource or path may be more appropriate.

3

You Review Before Deciding

A request does not require acceptance. There is no fixed response, price, or closing guarantee. Read the writing and seek independent advice if needed.

Quick FAQ

Q: Is there really no obligation?

Correct. Submitting the questionnaire does not require you to accept a proposal. Any later obligations would come from a written agreement you choose to sign.

Q: How much does this cost?

No separate fees or commissions are charged to you on a direct cash sale. Benard Homes LLC's compensation is calculated into the transaction price — what is offered is what you receive at closing. On a novation (Fast Track) listing, compensation terms are disclosed in the written agreement before you sign.

Q: Why don't I just list with a real estate agent?

A traditional listing may be the better fit when market exposure and potential net proceeds outweigh the preparation, showings, time, costs, and contingencies involved. A licensed real-estate agent can provide listing advice and a comparative market analysis.

Q: Are you going to lowball me?

A proposal may not be available for every property. If one is made, compare the price and estimated net with realistic alternatives before deciding.

Q: How long does this take?

Timing varies with the property, information available, inspection or walkthrough needs, title issues, and the proposed structure. There is no fixed response or closing guarantee.

Q: What if I'm in foreclosure?

Do not ignore notices or deadlines. Contact your mortgage servicer and consider a HUD-approved housing counselor or Utah attorney. A sale may be one possible path, but it does not automatically stop foreclosure.
