The Process
A direct transaction may be proposed on an as-is basis when the property fits. Repairs, cleaning, personal property, access, and final condition should be stated in the written agreement.
No separate fees or commissions are charged to you on a direct cash sale. Benard Homes LLC's compensation is calculated into the transaction price — what is offered is what you receive at closing. On a novation (Fast Track) listing, compensation terms are disclosed in the written agreement before you sign.
A novation agreement (also called the Fast Track Program at Benard Homes) is a hybrid option where Benard Homes lists your home on the MLS to maximize market exposure while providing the same hands-on support as a cash sale. If the home does not sell within the agreed timeframe, Benard Homes purchases it directly. All terms — price, timeline, and compensation — are set out in the written agreement before you sign.
A 'subject-to' purchase means a buyer acquires the property while the existing mortgage remains in the seller's name. The buyer makes the payments, but the original borrower retains legal liability for the loan. This arrangement carries significant risk for the seller and should only be considered after consulting a licensed Utah real estate attorney.
A request or conversation does not obligate you to accept a proposal. After signing, cancellation rights depend on the written agreement and applicable law, so read the document and consider independent legal advice before signing.
